Agreement to Terms

Welcome to Bloom. These Terms of Service ("Terms") govern your access to and use of the Bloom application, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Description of Service

Bloom is a habit tracking and family coordination application designed to help families build better habits together. The Service includes:

• •Habit creation, tracking, and management tools
• •Family group features for collaborative habit building
• •Gamification elements including XP, badges, streaks, and rewards
• •Progress visualization and statistics
• •Premium features available through subscription

Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• •Provide accurate, current, and complete information
• •Maintain and promptly update your account information
• •Keep your password secure and confidential
• •Be responsible for all activities that occur under your account
• •Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you must have parental consent. Children under 13 may only use the Service through a family account managed by a parent or guardian.

Family Accounts

If you create or manage a family group:

• •You are responsible for all activity within your family group
• •You agree to only invite people who have consented to join
• •For child accounts, you represent that you are the parent or legal guardian
• •You consent to the collection and use of children's data as described in our Privacy Policy
• •You may review, modify, or delete your children's data at any time

Acceptable Use

You agree not to use the Service to:

• •Violate any applicable laws, regulations, or third-party rights
• •Upload or transmit harmful, offensive, or inappropriate content
• •Attempt to gain unauthorized access to the Service or other accounts
• •Interfere with or disrupt the Service or servers
• •Use automated means to access the Service without permission
• •Impersonate another person or entity
• •Harass, abuse, or harm other users
• •Circumvent any security features or usage limits

User Content

You retain ownership of content you create within the Service, including habit names, descriptions, custom rewards, and other user-generated content ("User Content"). By creating User Content, you grant us a limited license to:

• •Store, process, and display your User Content to provide the Service
• •Share your User Content with family members you have invited
• •Use anonymized, aggregated data to improve the Service

You are responsible for your User Content and represent that you have the right to share it. We may remove User Content that violates these Terms.

Subscriptions and Payments

Bloom offers both free and premium subscription plans. For premium subscriptions:

• •Billing: Subscriptions are billed in advance on a recurring basis (monthly or yearly)
• •Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
• •Price Changes: We may change subscription prices with 30 days notice
• •Cancellation: You may cancel at any time; access continues until the end of the billing period
• •Refunds: Refunds are provided in accordance with applicable laws and our refund policy

For subscriptions made through the Apple App Store or Google Play Store, their respective terms and refund policies apply.

Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Bloom and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code, unless permitted by law or with our written consent.

Third-Party Services

The Service may integrate with or contain links to third-party websites, services, or content. We are not responsible for third-party services and their use is at your own risk. Third-party services are governed by their own terms and privacy policies, which we encourage you to review.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• •Merchantability and fitness for a particular purpose
• •Non-infringement of third-party rights
• •Accuracy, reliability, or completeness of content
• •Uninterrupted, secure, or error-free operation

Bloom is a habit tracking tool and does not provide medical, psychological, or professional advice. Always consult qualified professionals for health-related decisions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOOM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• •Loss of profits, data, or goodwill
• •Service interruption or data loss
• •Unauthorized access to your account or data
• •Any other damages arising from use of the Service

Our total liability shall not exceed the greater of $100 USD or the amount you paid us in the past 12 months.

Indemnification

You agree to indemnify, defend, and hold harmless Bloom and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

• •Violation of these Terms
• •Conduct that we determine is harmful to other users or the Service
• •Extended periods of inactivity
• •Request by law enforcement or government agencies

You may delete your account at any time through the app settings. For full accounts, deletion is scheduled with a 30-day grace period during which you can restore access. Managed child profiles can only be deleted by a parent or admin. Upon final deletion, your right to use the Service will cease.

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bloom operates, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

Changes to These Terms

We may modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. For material changes, we may also notify you through the app or via email. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
